This agreement provides important information about your responsibilities for your content, our responsibilities to you, your agreement to resolve any disputes through individual arbitration, and your waiver of the right to participate in any claims against Smart Online Solutions or its affiliates or founding partners. By accessing the Alsooq Online platform and website, you agree to the following terms:

Your Account:

To access certain services on Alsooq Online, you are required to create a personal account using your email address and a password of your choice. Your email address will serve as your official contact, and you are responsible for keeping your password confidential and for all activities originating from your account. It is crucial to protect your password and choose one that is not easily accessible by others. We recommend that all users enter their first and last names in the "Username" field and refrain from using any trademarks unless they own the rights to use them, such as "Alsooq Online," and so on.

Usage:

The Alsooq Online website and application allow postings in any of our sections, with the following restrictions:

Posting false or misleading advertisements.
Infringing upon the rights of any third party.

Prohibited Content:

Any ad containing one or more of the following prohibited items will be deleted, and the site reserves the right to permanently delete the user's account, blacklist the user, or report to the relevant law enforcement authorities according to the applicable laws and regulations in each country where the ad is posted. These prohibited items include but are not limited to:

Alcoholic beverages, alcohol, tobacco products, drugs, narcotics, intoxicants, and medications, or even providing direct or indirect links to materials and products or services prohibited by law.
Human or animal organs, blood, and body fluids.
Prostitution or any services that violate ethical standards, or indecent representation of women, children, or anything that violates contemporary moral and ethical standards in Arab societies.
Religious materials, including books, artifacts, and so on, or any information or descriptions of these materials that offend the religious sentiments of any person, group, or sect.
Sexual innuendos, including hints of slavery, idols, and so on, or depicting reproductive organs, and so on.
Items or treasures prohibited from being traded under any applicable law.
Information, materials, drawings, or tools that imply insults, defamation, threats, or even bullying.
Forged information about the nature or method of using products and services.
Counterfeit goods, stolen goods, or illegal and unauthorized services.
The personal belongings of other people without their explicit consent.
The transfer of electronic computer viruses or any program that can pirate computer systems, damage them, and steal personal data.

Please refrain from including any content that insults users, the state, the site, animals, children, women, and so on.

Misuse of Alsooq Online Site:

If you come across any issues or inappropriate content on the Alsooq Online site, please report it so that we can work together to maintain the proper functioning of the services we provide. We reserve the right to terminate our services for those who misuse the site or the associated smart applications, remove their content, and take legal actions to protect the rights of other users.

The site and its owning company bear no final legal responsibility for the nature of any inappropriate content published and its subsequent consequences. The affected party has the right to resort to legal action.

The following practices are prohibited when posting on Alsooq Online:

Creating more than one account.

Posting duplicate advertisements.

Posting advertisements with misleading titles, content, and images.

Posting advertisements with incorrect or inappropriate images.

Posting advertisements in the wrong categories.

Posting advertisements with unreasonable prices.

Posting advertisements with redirection links to other websites.

Uploading images containing names and phone numbers.

Posting advertisements that include prepayment or bank transfer options.

Posting general or generic advertising content.

Posting advertisements with multiple items.

Posting clothing items without uploading images of them.

Posting fraudulent or fake ads.

Content:

Alsooq Online contains content provided by the website itself and by users. As a user of the site, you agree not to copy, modify, or publish our copyrights and trademarks. When you post any of your content on our site, you grant us a permanent right that cannot be revoked, subject to the rights and content publishing policy followed on the site. If you feel that your rights have been violated, please inform our customer service department, and we will investigate the matter. We retain the right to remove any content that violates our terms and conditions or the rights of other parties.

Reporting Intellectual Property Violations:

Users are prohibited from posting any content that violates the intellectual property rights of third parties, including but not limited to violations of intellectual property rights and trademarks (e.g., advertising counterfeit items for sale, etc.). We reserve the right to remove any content that violates our posting policies and to protect the rights of others. If you believe that one of our ads violates your intellectual property rights and trademarks, all you need to do at that time is to contact our customer service department. Only the rightful owner of these rights can file a complaint against the terms and ads that are likely to infringe on them.

Fees and Services:

In general, advertising on Alsooq Online is free; however, we impose fees for some services that we provide to users. If you use a service for which we charge a fee, you will be required to review and accept it, and payment can be made either in the local currency or in US dollars. We may change this payment method from time to time, and we will notify you of any changes to the payment policy by publishing it on the site. We may choose to make some temporary changes to the payment method when posting promotional ads or new services.

Fees are non-refundable, and if you do not review and accept them, we will invalidate the service you used.

Advertising for Agencies:

This term refers to third-party agencies, services, or publishing service-related content on behalf of others. The policy of Alsooq Online prohibits such advertising, whether directly or indirectly, without obtaining written permission from the third party (the agency). Additionally, posting ads on behalf of the concerned parties is prohibited without written permission or a license from the site itself.

Disclaimers and Limitations of Liability:

Alsooq Online provides services as they exist or as they are available, and as a user, you agree not to hold the website legally responsible for any content posted by other users or third parties, including but not limited to advertisements or direct messages between users.

The website does not guarantee the accuracy of ads or the means of communication, security, or compliance with laws because most of the content on the site is posted by users. In addition, there is no guarantee of continuous access to services, and there is no real-time alert system for services. These issues are beyond our control, including delays or latency due to your geographical location or internet connection status. According to the legally permissible limit, we disclaim all warranties, express or implied, including quality, popularity, nature of business, or suitability for the purpose for which it was intended.

We do not assume any legal liability of any kind for any loss, whether monetary (including profit), reputation, special or indirect damages resulting from your use of the site, even if we have been informed of it or expected it to occur. Some jurisdictions do not allow for the waiver of warranties or the exclusion of damages, so such disclaimers and exceptions do not apply to you.

Nevertheless, if we find ourselves responsible for you or any third party (whether in the contract concluded or in any other way), our liability is limited to the most by the total amount paid by you for our paid services for your site account directly during the 3 months preceding the act causing liability or $10 USD or the equivalent in other currencies.

Compensation:

You shall be liable to provide compensation to any third party or to the website, or to the company owning the website in the event of a complaint filed against you (the user), including any amounts payable to them, whether upon settlement or as previously awarded. This compensation also encompasses any legal costs incurred by any of the involved parties due to your use of the online market and the violation of any terms of use and applicable laws. Neither the website, nor its administrators, employees, nor officials shall be held responsible for any of these compensations. The website retains the right to defend and control any legal matter, without exempting you from the obligation to pay such compensations.

Personal Information:

When you use the Alsooq Online marketplace, you consent to the collection, transfer, storage, and use of your personal information across various other sites by the website.

Alsooq Online Wallet:

The Alsooq Online Wallet is a prepayment system that allows registered members of the Alsooq Online marketplace to purchase credit for use in acquiring the services offered by Alsooq Online. The credit in the Alsooq Online Wallet cannot be exchanged for cash, and users cannot earn financial interest or profits. Only registered members with good standing are permitted to purchase credits and utilize the Alsooq Online Wallet. All credits in the Alsooq Online Wallet, once purchased, are final and non-refundable. Alsooq Online reserves the right to suspend the sale of wallet credits or change the cost and the method by which registered users can purchase, store, or use the credits in the Alsooq Online Wallet.

Notice:

The currency exchange rate from the US dollar to the local currency may be subject to a conversion fee of 2% to 10%, imposed by banks, depending on the local exchange rate.

Users of Alsooq Online marketplace can use their wallet to purchase any of the following products or services:

Featured advertisements

Reposting

Premium memberships

Stores

Business profiles

Any other services that may be made available in the future by Alsooq Online marketplace

Registered users cannot use their wallet balance to purchase products and services that are not offered through the Alsooq Online marketplace, or to buy goods and services provided by other users of the website.

Transferring the wallet balance to another user of the website is not allowed.

There is no expiration date for wallet balances purchased by registered users. However, in the event that a user's account is inactive or suspended for any reason, all wallet balances will be automatically forfeited.

Alsooq Online reserves the right to seize or cancel any wallet balance acquired directly or indirectly or through fraudulent or illegal means without the need to notify the user.

If the management of Alsooq Online has reasons or evidence confirming that any users have violated the terms of wallet usage or other terms of use on the website, they may block the use of the Alsooq Online wallet, delete or modify ads, whether paid or free. By using the Alsooq Online wallet, you agree that this can be done at any time without prior notice.

Alsooq Online may update, change, or completely or partially terminate any content and services, including the wallet of Alsooq Online, or these terms and conditions. Any update, change, or termination becomes effective immediately upon being published on the Alsooq Online website, whether on its platform or services.

Alsooq Online retains absolute rights to control, terminate, modify, and organize the content, services, technology, and platform related to the Alsooq Online wallet as deemed appropriate by the management of the Alsooq Online website. The website is not responsible for the exercise of any of these rights.

Alsooq Online may conduct audits of any user's Alsooq Online wallet accounts to check for potential system errors or to verify any potential violations or reports regarding the terms, policies, and rules applicable on Alsooq Online.

Any dispute related to the Alsooq Online wallet should be reported within 24 hours of the user discovering the issue. Failure to do so means the user has waived the right to file any claims against Alsooq Online. All problem reports sent to Alsooq Online must include at least the following information:

User's name

Registered mobile number on Alsooq Online

Total wallet balance in dispute (if applicable)

Description of the problem

Date and time of the problem

Request for correction or compensation

Any other relevant information for the report

If there is any issue with a payment made through PayPal, the user must contact PayPal directly. By using your personal credit card, PayPal account, or any other payment options available on Alsooq Online to purchase wallet balances, you agree to be the legitimate owner of the credit card or PayPal account. If you are not the legal owner of the credit card or PayPal account or other payment options, you undertake to assume responsibility for any transactions, as approved by the legitimate owner, and understand these terms and conditions.

The user acknowledges and agrees that they cannot use their wallet balance in the Alsooq Online wallet for anything other than purchasing services provided by Alsooq Online. When you purchase a wallet balance in the Alsooq Online wallet, you are using it within the limits of personal and revocable privileges, as outlined in these terms and conditions, and you are not allowed to transfer this privilege to another user.

Alsooq Online is not responsible for any failure to receive any communications, updates, offers, or any information related to the Alsooq Online wallet or its usage.

Alsooq Online retains the right to suspend, terminate, or discontinue the "Alsooq Online Wallet" service at any time and without prior notice.

The determination of a user's eligibility to benefit from or use Alsooq Online Wallet services is subject to these terms and conditions. Any queries or issues related to this wallet and its usage will be resolved at the discretion of the Alsooq Online management.

Misconduct, fraud, information falsification, misuse, or unauthorized access to the Alsooq Online Wallet service, and non-compliance with any of these terms, will result in the immediate termination of the user's account without affecting the website's other legal rights. Furthermore, the website will not be liable for any risks, losses, damages, or claims resulting from the complete account termination.

All of these terms and policies announced on Alsooq Online constitute an agreement between you and the company that owns the website, replacing any previous agreement. This agreement is subject to the laws applicable in Arab countries (Kuwait, Egypt, Saudi Arabia, UAE, Qatar, Bahrain, etc.). This will never affect your legal rights if you are a consumer, and the application of another law (such as the law of your country of residence) is required for specific matters. If we do not require certain terms, we will not waive our rights to do so later. If the court nullifies any of these terms, the remaining terms will still be in effect, and we reserve the right to automatically amend or reassign this agreement according to the notification terms below.

Alsooq Online has the right at any time, according to the company's exclusive judgment, to reject, transfer, or delete any content or membership.

We will send notifications to the email address you provided, or the one you previously registered with.

Notifications sent via official mail require five business days from the date of sending.

The website has the right to update the terms of use at any time, which will be effective upon your first login to the website after updating the terms or after 30 days from the update, whichever is sooner.

You can send inquiries, comments, or complaints to our customer service team.

Terms of use for mobile phones: If you are using Alsooq Online through our mobile application, these terms of use and the privacy policy published on the website apply to you, in addition to the mobile phone-related privacy policy, legal notices, and client license agreement. Your use of the application confirms your agreement to these terms of use.

Application Usage:

Alsooq Online grants you the right to use its application for personal use. Therefore, you must comply with all applicable laws and third-party terms of service agreements (such as the Wireless Network Service Agreement). The application may not contain all the features and services provided by the Alsooq Online website. You can download and use the Alsooq Online application, and you are responsible for any damage to your device or data loss resulting from downloading and using it.

Intellectual Property:

Applications: Alsooq Online owns all rights, ownership, and interests in its applications, including patent rights, copyrights, trade secrets, and trademarks, and all other property rights, including additions, updates, and modifications to its applications.

Modification, translation, creation of business models by decompiling code, software engineering, codes, or any other attempt to derive codes from another application is not allowed. Removing, hiding, or altering copyright, trademark, and intellectual property notices within or when accessing any of the Alsooq Online applications is also prohibited.
